when caught but not before wounding his young daughter who was with him. one suffered life-threatening injuries. the tribe said he had a real hard life. >> the coast guard and a solano county dive rescue team are looking for 577-year-old man who is believe to have fell into the mare island strait. he was last seen on his tug boat. he never came home. his son found the tug boat unlocked and his dad's car parked at the berth. >> this area is being sold as nobe. north oakland, berkeley, and emeryville. tomas roman is live in the neighborhood with more. >> some realtors started to use the name nobe to describe this north oakland neighborhood known usually as the golden gate district. and some resident wes spoke to say this name change is just a ploy to raise home plieses and displace low income families.

>> scott and laurel moved from san francisco into this area which some real tore refer to as nobe. >> it's reasonable shopping around. lots of kids in the neighborhood. lots of people walking their doings. this is nice. >> rosa says she loves north oakland and has lived in this home for 30 years. >> this is a long-standing north oakland community that is being swallowed up by real estate agents. reporter: she does not like the idea that real estate agents and brokers are selling her neighborhood as nobe, standing for north oakland, berkeley, emeryville. she says it's plan to sanitize an area of oakland to boost home prices and gentrify the area. >> feels like we're a pawn in this game of real estate prices and people wanting to think of oakland as only the bad news they see about shootings. >> five shootings in oakland on saturday that left one person dead does nothing for oakland's identity as a destination. real estate protectors like daniel winkler says the name

change represents the revitalization of the area. new restaurants, easy access to transportation and old, sturdy homes attract new families. winkler likes the name and is sell this home for $849,000. a block from the oakland border. >> didn't think of it as a name change. the creation of a district, or getting an identity. >> the area has been known as the golden gate district, or just north oakland to residents. kelly is a partner in the james and giant cupcake shop in oakland. >> i don't really think it needs to change. the neighborhood can grow and the name can stay the same. reporter: now, some residents plan to fight the name change to nobe. there's no telling if it will camp on like soma did for south of market in san francisco. abc-7 news. >> ama: proposed legislation that could increase the number

of smoke-free apartment in san francisco will be discussed. a board of supervisors committee is scheduled to hear the legislation. the policy would require landlords to designate their apartment units as smoking or nonsmoking and disclose the information to tenants. the san francisco apartment association backs the proposal. >> breaks news out of san francisco. caltrain has stopped service in both directions when a train rammed a car half hour ago. everybody inside the car government out safely about the collision. the caltrain was headed northbound into downtown san francisco when then incident happened. >> the union city woman convicted of killing nursing student michelle le is scheduled for sentencing tomorrow. state law requires her to spend a minimum of 25 years in prison after an al immediate a county jury convicted her of first degree murder in october. properties say she killed ln a jealous rage. >> two recent oakland homicide vices are being railroad.

>> ama: president barack obama and house speaker john boehner met today to discuss the impending fiscal cliff. they're trying to find a deficit cutting deal to stop a combination of tax increases and spending cut to kick in. some government agencies are making contingency plans. here's that part of the story. >> preparing for the holidays is a reminder of something else just around the kosher, a -- corner, fiscal cliff deadline that is permanent here. >> i can't imagine funding being cut. it would be tragic. >> she is worried mandatory

budget cuts would hurt food safety inspection. >> he was in the hospital for three weeks. >> she and her babies got poisoning from meat she ate while pregnancy. the cdc says contaminated food sickens 38,000 people a year, 3,000 people die. so the fda are charged with protecting the food supply. an 8.2% budget cut translates to a combined $157 million. >> there's no word exactly what cuts would mean to inspector staffing. >> both the fda and usda-already stretched thin when it comes to inspection activities. they need increased resources, not fewer resources. >> agencies all say they're stretched. >> he is with freedom works and that's the cuts leave nothing to fear. >> arguing that getting spending under control endangers public

doppler 7hd is seeing clear skies but for long. the radar on mt. st. helena will be watching for rain tuesday night and wednesday. temperatures in the 60s in the bay. and inland valleys, already dropping down into the 50s. here's the highlights. clear and cold the valleys. sunny and mild for monday. rain returns tuesday, going into wednesday. tomorrow morning's commute looks fine but you'll need to bundle up, scarves, gloves, a coat, it's going to get cold. 37 by morning in napa. fairfield, dropping to 40. 45 in oakland. san francisco north that cold, 48. san jose, 45. vallejo, 40 degrees. make sure you grab a coat or jacket when you head out the door. but it will be clear. high pressure controlling our weather. this fridge of high pressure is hanging on for another day. so above average temperatures again for your monday. mild sunny skies will continue.

but then we're going to fast-forward to tuesday night. things really start to change. 11:00 p.m. the rains starting to approach santa rosa, tuesday night. wednesday, the wee hours of the morning, 3 al, we'll see the rain coming through the bay area as the cold front is sliding through. and by 5:00 a.m., this where is it looks messy. many of you heading out the door to head off to school or go to work. it does not look good at this point. the rainfall is expected to be briefly moderate. light to moderate, and at 7:00 a.m., rain is still continuing, turning more showery on the back end of the front as we head into the latter part of the morning and the early afternoon. tomorrow afternoon, though, don't worry about the umbrellas. wash your cars. 63 in sunnyvale. on the peninsula, 65. palo alto, 64. pacifica, 63. same thing for downtown san francisco. north bay, going to be mild. near 70 in santa rosa, 67, san rafael. east bay, 66 oakland. inland valleys, nice day. 66 dan vicialtion 64 in concord,
